Terms & Conditions

This agreement and any shipment here under is subject to all terms and conditions of the carrier’s tariff and the uniform straight bill of lading, copies of which are available at the office of the carrier. Ababil Stones U.S. Department of Transportation Broker’s license # 1348952.

This supersedes all prior written or oral representation of Ababil Stones and constitutes the entire agreement between shipper and Ababil Stones and may not be changed except in writing signed by an officer of Ababil Stones . Ababil Stones has authorization to cancel order at anytime.

1. The carrier and driver jointly and separately are authorized to operate and transport his/her or their motor vehicle between its pick up location and the destination set forth on the auto transport order contract.

2. Trucking damage claims are covered by carrier from $100,000 up to $250,000 cargo insurance per load, and a minimum of 3/4 of a million dollars public liability and property damage. All claims must be noted and signed for at time of delivery, and submitted in writing within 15 days of delivery.

3. Ababil Stones agrees to provide a carrier to transport your vehicle as promptly as possible in accordance with your instructions but cannot guarantee pick-up or delivery on a specified date. An administration fee of $200 will be charged for orders canceled prior to one week after the requested available pick up date. Ababil Stones does not agree to pay for your rental of a vehicle, nor shall it be liable for failure of mechanical or operating parts of your vehicle.

4. The price quoted includes 7% discount for cash payment, (credit card customers and billing accounts will be charged full amount). Pick up and delivery is from your door unless residential area restrictions apply. Pick ups by appointment are available for an additional fee, by smaller unrestricted auto carriers.

5. Vehicles must be tendered to carrier in good running condition with no more than a half tank of fuel. Carrier will not be liable for damage caused by leaking fluids, freezing, exhaust systems, or antennas not tied down. Any claim for loss or damage must be noted and signed on condition report at time of delivery.

6. LUGGAGE and personal property must be confined to trunk, with no heavy articles, and not to exceed 100 lbs. Carrier is not liable for damage caused to vehicle from excessive or improper loading of personal items. For overseas shipments (including Hawaii) vehicles must be empty, except for factory installed equipment. Any article left in vehicle will be removed at shipper’s expense.

7. Shipper warrants that he will pay the price quoted due Ababil Stones for delivered vehicles, and will not seek to charge back a credit card. A $150.00 non-operational fee will be charged for all non-running vehicles. This will be included in the final quote received from Elite Auto Shipping. If the vehicle becomes non-operational during transport, this fee will be applied to the original quote

If a carrier is sent out and the vehicle isn’t ready as indicated by the shipper there will be an additional $75.00 rescheduling fee. Ababil Stones must be notified, should the shipper be unavailable for pick up or delivery, the shipper must have an alternate representative take his/her place as shipper. If for any reason the vehicle becomes unavailable during a scheduled pick up window, after an order has been placed, Ababil Stones has the right to cancel the order with no refund.

 

PAYMENT: Customer credit card will be charged immediately when Carrier is assigned. If the final total quote is different than originally quoted amount, Customer credit card will be charged immediately upon authorization by the Customer. Once Customer credit card is charged for the initial deposit, the price will not change unless there are extenuating circumstances of the Customer’s fault, not limited to but including: inoperable vehicle not disclosed, cargo in vehicle, customizations of vehicle not disclosed, etc.

Customers placing an initial partial payment on a credit card will be charged when Carrier is assigned, and Customer must make any remaining payment to Driver (Carrier) upon pickup or delivery in the form of cash or certified check, made out to the company listed on the final “carrier assigned” confirmation email (note: do not make certified checks out to Ababil Stones unless specifically instructed to via email). Customer acknowledges and understands that all charges by Company and Carrier must be paid in full prior to Vehicle being released. All payments are either COD or COP (or certified check on delivery or pickup) unless a full card payment is expressly authorized by Company. All full card payments will be charged a minimum of 5% surcharge. Customer agrees to pay all sums due Company for delivered Vehicle and will not seek to charge back a credit card or stop payment on a check to offset any dispute for delay or damage claims and will abide by the terms of the Agreement to handle such disputes. All Customer credit card disputes will be subject to a minimum of $195 additional fee to be automatically assessed once said dispute is won or lost by Company. Company shall have a lien on Vehicle for all sums due but not paid and may refuse to release Vehicle until payment is rendered. Company will seek legal title to Vehicle left unclaimed at destination after a period of 30 days and may sell or otherwise dispose of Vehicle as allowed by law.

 

CANCELLATION POLICY: Customer cancellations are subject to a minimum cancellation fee of one hundred ninety-five dollars ($195). If the cancellation request date is before the start of the Ready Date a $195 cancellation fee may be assessed. If the cancellation request date is more than 7 days after the start of the Ready Date and a Carrier has not been assigned, the cancellation fee will not apply. Once a Carrier is assigned in any scenario, cancellation fees will not be waived and the non-refundable shipping deposit will not be waived. Once a vehicle is picked up by a Carrier or dropped off at a port, customer cancellation is no longer available. The deposit is non-refundable in any scenario except the time if an agent could not find a carrier to transport a car within 7 days it’s subjected to take another 7 days to assign proper carrier, if an agent can’t find any carrier to transport a car within these two weeks period of time then deposit will be refunded. If a carrier is assigned, and the requested deposit and/or quote is less/more than the original quote, we will reach out to authorize the pricing difference.
